Our focus on employment litigation includes emerging issues under Title VII of the Civil Rights Act of 1964 and state law equivalent, the Americans with Disabilities Act, common law Wrongful Termination Claims, Law Against Discrimination Claims (LAD), Railroad Labor Act, Equal Employment Opportunity litigation, Affirmative Action issues, Worker Adjustment and Retraining Notification Act, Civil Rights claims brought under Sections 1981 and 1983, the Family Medical Leave Act (FMLA), Bullying, LBGTQ issues, issues of reasonable accommodation under the Americans with Disabilities Act, e-mail and workplace privacy laws, drug testing in the work place, the New Jersey Law Against Discrimination and all other legal theories for employment related litigation.
In addition, we regularly provide pre-litigation advice and/or litigation representation involving claims under the False Claims Act – including individuals, educational institutions, health care and other research institutions, and those involved with governmental or military contracting.
We have also represented school board clients in state and federal courts, and appear before administrative forums including the Commission of Education, Office of Administrative Law, and the State Board of Education. Representation includes a broad spectrum of issues including wrongful termination, discrimination, personnel disputes, bidding disputes, special education matters, tenure, disciplinary proceedings, contracts, construction and premises liability.
