Our New Jersey law firm represents owners, developers, general contractors, subcontractors, second-tier subcontractors, suppliers, manufacturers and design professionals in a variety of private, public, and commercial construction disputes.  Our Construction Law attorneys are familiar with all aspects of construction litigation including delay and defects claims, causes of action under the Miller Act, bond claims, construction lien claims, Municipal Mechanic Lien Claims, the New Jersey Home Warranty Act, claims involving the patent ambiguity doctrine and the Public Works Bond Act matters. We are result oriented attorneys. We work hard and provide excellent results. We understand the needs of business owners involved in the construction industry. Time is money. We get it. Our job is to help you navigate through a broad range of construction law matters efficiently and professionally. We provide advice before problems arise.  Frequently, owners or contractors call us for advice on how to protect the labor or materials they provide to insure that they get paid for their efforts.

Legal Advise for Contractors, Engineers, Architects and Suppliers

We frequently advise general contractors, construction managers, engineers, architects, subcontractors, and material suppliers in contract drafting and disputes, Change Order claims, Requests for Information (“RFI”), Construction Change Directives (“CCD”), disruption, loss of productivity, and home office overhead (Eichealy) damages.  We have vast knowledge of insurance, fidelity, surety, indemnification and contract issues.  We routinely negotiate construction contracts involving multi-million dollar projects and are intimately familiar with how plans, contracts, and specifications relate to each other.  We work with Construction Managers so that projects are completed smoothly and profitably.  We have negotiated Joint Venture Agreements under section 8(a) of the Business Development Program (SBA).

Our lawyers have experience in handling legal issues relating to delay, acceleration, disruption, inefficiency, cumulative impacts and claims for error and omissions by design professionals who fail to properly coordinate construction drawings.  We have represented contractors in disputes with the Federal Government, including the US Army Corps of Engineers (“USACE”) involving a Request for Equitable Adjustment (REA) and other issues under The Contract Disputes Act.

At the law offices of Garrity, Graham, Murphy, Garofalo & Flinn, we understand the bidding process, how to protest a bid, issues relating to labor and prevailing wage claims, and the impact projects can have on a contractor’s ability to obtain bonds. Our litigation experience has involved construction disputes arising out of the development of schools, libraries, firehouses, parks, recreational facilities, condominium projects, residential developments, among other projects. Recent settlements have included an $1,200,000 payment by a New Jersey municipality for the wrongful termination of a contractor on a public project and a substantial settlement with the United States Army Corp. Of Engineers.

With the ability to handle all phases of construction litigation including defect claims, professional liability, condominium/townhome and residential/commercial developments, our lawyers are uniquely qualified to participate in the smallest of construction disputes to large and complex cases.  Our legal firm represents clients in the litigation, arbitration, and mediation of construction related matters in the private and public sector. We understand how surety companies operate and the impact a surety can have on a project if an owner declares that a contractor is in default.  We have counseled owners and construction managers in dealing with contractors so that projects are completed. Our attorneys have negotiated Takeover Agreements with bonding companies and municipalities or state agencies.
If you are a homeowner in Bergen, Essex or Morris county NJ or anywhere in the New York / New Jersey metropolitan area and need legal advice on dealing with a contractor, we can help. Our attorneys have represented many homeowners in reviewing construction contracts and in litigation against contractors whose workmanship is poor.  We have obtained substantial settlements and verdicts against contractors who do not perform quality work including the recent settlement of $1,000,000 against a developer/contractor who built a new home that contained many construction defects.

Our law office has represented condominium associations in claims against builders and provides expert advice on how to handle such claims. Our lawyers have provided legal advice to condo associations on all aspects of development, construction, repairs, added assessments, and enforcement of lien claims against individual unit owners who do not pay their assessments. We have a detailed range of experience in serving as counsel to condominium associations. We recently negotiated a $5,000,000 settlement on behalf of a condominium association related to fire damage to a complex.  We counsel clients on common element claims, the formation and management of Condominium Associations, and the drafting of by-laws and regulations.

Our firm has extensive experience representing contractors, construction professionals, design professionals, construction managers and property owners and lessors in cases involving serious injuries on the work site throughout New Jersey and parts of New York City.  We are experienced in complex commercial construction projects, roadway improvement projects, home developments, condominium developments, loading and unloading facilities as well as industrial and business centers.  Our experience includes the sophisticated interplay of contractual indemnification, additional insured and multiple party insurance policies including various OCIP or Wrap-Up policy programs or devices used for today’s complex construction and risk management.

Our firm has been involved in both trial defense and coverage representation of participants in litigation involving many construction projects in New Jersey and New York.

Concerning coverage, we are experienced with issues involving triggers of coverage, vertical and horizontal coverage disputes, allocation, indemnification and contribution claims, reimbursement and defense claim, statute of repose issues, subrogation rights of an insurer, performance and payment bond  claims, the Federal Arbitration Act, and priorities among claimants.
